Jake Gardner, who was charged with the death of James Scurlock, has committed suicide

Jake Gardner, who was charged with the death of James Scurlock, has committed suicide. Per authorities in Omaha, Gardner was supposed to turn himself in on Sunday, September 20, 2020. Last week, on Tuesday, September 15th, 2020, Special Prosecutor Frederick Franklin, announced the grand jury results from the investigation of the death of James Scurlock, during the May "George Floyd" protests. The Grand Jury issued an Indictment for manslaughter, use of a deadly weapon to commit a felony, attempted first-degree assault and terroristic threats. The indictment came several months after county attorney, Don Kleine, initially agreed with Gardner that he had shot Scurlock, 22, in self-defense, and was free from any charges.

After being released from questioning, Gardner left Omaha for California. Per his attorney's he was in fear of local retaliation. But after the indictment was issued, Gardner was given the option of turning himself in or being issued a warrant for his arrest. Arrangement were made with his attorney and authorities, for Gardner to turn himself in on Sunday evening. Gardner was to be escorted by a fellow vet, a a bodyguard, for fear of death threats, per his attorney. But instead Wagner was found dead yesterday, by suicide. Police in Oregon released the following statement, "At about 12:20 p.m., Hillsboro Police Department officers responded to the 300 block of Southeast Ninth Avenue after a body was found outside a medical clinic. They discovered 38-year-old Jacob Gardner of Omaha, Nebraska, dead."

"Gardner was a decorated veteran of multiple tours in Iraq, and had suffered from two traumatic brain injuries", said Dornan. Also per Dornan, Gardner said he felt like he was in a war zone the night of Scurlock's death. Gardner's attorney said the indictment came as a shock to Gardner. But although the indictment came as a shock to Gardner, the PTSD claims come as a shock to the community. Especially because of the posts that Gardner made prior to the incident, on Facebook, including a post stating, "just when you think what else could 2020 throw at me? Then you have to pull 48 hours of military style firewatch". Authorities had warned downtown business owner's to stay away from the area during the protests, which Gardner disregarded. So many people believe that had he listened to authorities, he and Scurlock would still be alive today.

Attorney Tom Monaghan said that social media convicted Gardner before the grand jury indicted him.

"There's no way to defend the lies on social media. When you respond, you only make it worse," he said. "We have to stop the lies." "I want to make it very clear that this was a clear case of self-defense," Dornan said, describing Gardner as cooperative with police. Despite feeling that way, there are many in the community of North Omaha who feels differently, believing all along that Gardner's actions were not of self-defense. And evidently, the grand jury didn't believe it was self-defense either. But due to the claims of suicide, we'll never know the outcome of the trial, if he would have been found guilty or innocent. As a matter of fact, there are posts being made on Facebook from people demanding to see Gardner's body, despite claims that he has committed suicide.
